1About these Terms
These Terms are an agreement between you and Dereck Ruzzman, who runs Car Repair Estimate. "We", "us" and "our" mean Dereck Ruzzman.
The app is licensed to you under Apple's Standard End User License Agreement (Apple's Standard EULA). These Terms are additional to Apple's Standard EULA and do not replace it.
By downloading or using the app, you agree to these Terms. Before your first scan, the app's AI consent screen also says "By continuing you agree to the Terms of Use", with a link to these Terms. If you do not agree, do not use the app.
You must be at least 18 to use the app. The app does not ask your age, so by using it you confirm that you are 18 or over.
Our Privacy Policy explains how we handle your data.
2What the service is
Car Repair Estimate is an iOS app for car owners. You photograph car damage, add details if you want to, and an AI model returns a preliminary repair estimate.
You are dealing with AI, not a person. The AI model comes from OpenAI. No person reviews an estimate before you see it.
We are not a repair shop, insurer, appraiser, adjuster or law firm, and we do not act as one.
3Estimates are AI figures and may be wrong
An estimate is a preliminary figure made by AI, based only on the photos and details you give. It may be wrong, and sometimes by a lot. We make no claim about how accurate estimates are.
An estimate is not:
- A repair quote, or an offer by anyone to do the work at that price.
- A shop's written estimate.
- An insurance appraisal or an adjuster's opinion.
- A safety inspection.
- A valuation of your car or a total loss decision.
- Legal, insurance, coverage or claims advice.
- A guarantee of any cost, repair time or part.
What to keep in mind
- The final cost is often higher. Shops often find more damage once parts come off.
- The AI can miss or misread damage. Photos cannot show structure behind panels, frame measurements, sensors, fault codes, wiring or past repairs.
- Prices are not from a shop. Parts prices and labor rates are AI figures for the location set in the app, which our server can limit or replace with fixed default rates. They have not been checked against local shops, and outside the US the AI has no baseline rates to work from. If that location is wrong, the estimate will be off too.
- Car value figures are rough. The car value, and any share of value shown, are rough AI figures. Your insurer decides whether a car is a total loss.
- Claim figures are simple sums. Any figure for what a claim may pay is only the estimate minus the deductible you entered. It says nothing about your coverage. Ask your insurer.
- Shops and insurers may reject it. A shop must inspect your car. Your shop or insurer decides the repair plan and the parts.
Use an estimate as a starting point. Get a written estimate from a repair shop before you decide on a repair.
4Safety warnings
In an emergency, or if anyone is hurt, call your local emergency number first. Do not use the app in traffic or anywhere unsafe.
The app can show a precautionary do-not-drive warning, based on what you report and what the AI sees in your photos. It is not an inspection, and it can be wrong either way. The app cannot tell you that a car is safe to drive. We cannot confirm that from photos.
- A warning can appear when the car could in fact be driven. Whether to arrange a tow, and the cost of it, is your decision.
- No warning does not mean the car is fine.
- Reporting no warning signs is not a clearance.
- If you say the damage happened earlier, the app does not ask about warning signs.
You decide whether to drive. If you are in any doubt, have the car towed and inspected by a qualified mechanic.
5The free estimate
You get one free estimate every 12 months. It shows the most likely cost, a cost range, the severity and the affected parts. The full report needs Pro.
Deleting your data or reinstalling the app does not normally reset this. See our Privacy Policy for why.
A scan does not count if it fails, or if the photos are rejected as not a car, too blurry or showing no damage.
6Pro subscription
Plans and prices
- Pro Yearly: $39.99 a year.
- Pro Weekly: $5.99 a week.
These are US prices. The App Store shows the price and currency for your country before you buy.
What you get
Pro gives you up to 10 new reports a month, with every part priced, a list of possible hidden damage, and a PDF to share.
- The limit is the same on both plans.
- A month is a calendar month in UTC, so the count resets at 00:00 UTC on the 1st.
- Unused reports do not roll over.
- Failed and rejected scans do not count.
- We may also limit how many scans you can run in a short time.
Auto-renewal
Your subscription renews automatically at the end of each year or week until you cancel. Apple charges your Apple Account at purchase and at each renewal.
The app offers an optional renewal reminder in Your plan. It comes about 3 days before a yearly renewal and about 1 day before a weekly one. It is a notification on your phone, and it is off until you turn it on. The app sets the reminder when you open it, so you may not get one if you have not opened the app since your last renewal, or if the renewal is already too close.
Cancelling
Cancel in iPhone Settings: tap your name, then Subscriptions. Apple's guide shows how. Cancel at least 24 hours before the renewal date to stop the next charge. You keep Pro until the end of the period you paid for.
Deleting the app or deleting your data does not cancel your subscription.
When Pro ends
Reports already saved on your phone stay readable there. Other full reports, such as after a reinstall, lock until you subscribe again. The overall result of each estimate stays.
Refunds
Apple processes payments and refunds, and we cannot trigger a refund in Apple's systems. To ask for a refund, use Apple's process at reportaproblem.apple.com.
This does not limit any legal right you have to a refund or price reduction from us. If Apple declines and the law entitles you to money back, contact us and we will pay you directly.
EU and UK right to withdraw
If you are a consumer in the EU or UK, you may have the right to withdraw from an online purchase within 14 days without giving a reason. Apple runs this for App Store purchases.
To withdraw, use Withdraw Transaction in your Apple Account's Purchase History, or email rightofwithdrawal@apple.com. Apple's EU terms and UK terms explain the time limit and when it may not apply.
These Terms do not ask you to give up this right.
Price changes
We may raise a price if our costs, taxes or exchange rates change. If we do, Apple will tell you before it applies, under Apple's rules. Where Apple's rules or the law require your agreement, your subscription will not renew at the new price without it.
Restoring a purchase
Restore is on the Welcome screen, in the app's Settings and on the paywall.
Restoring turns Pro on for this phone if your Apple Account has an active subscription, and it never charges you. Pro is tied to a random ID on your phone, so restoring on a second phone can move Pro off the first phone, or may not work there.
A new phone gets a new ID, unless you set it up from a backup of your old phone. Restoring normally brings back your subscription, but not your estimate history, which stays with the old ID.
7Your photos and estimates
Your content stays yours. You keep your rights in your photos, notes and other details you enter.
Permission to use it. You give us a limited, non-exclusive, worldwide permission to use that content to run the service. That means processing it, sending it to OpenAI and the other providers in our Privacy Policy, making your estimates, and storing the results as that policy says.
Your promises. You confirm that you have the right to upload each photo and that it does not break anyone's rights. Try to keep faces and license plates out. Keep children out.
Your estimates. You may keep, use and share your estimates for your own personal purposes, including showing them to a shop or insurer as a rough guide. If you share one, do not change it. This does not give you access to a full report that has locked (section 6).
8Acceptable use
The app is for car owners' personal use. You must not:
- Break the law or anyone's rights.
- Upload sexual, abusive or illegal content, or any image that exploits a child.
- Upload photos unrelated to car damage, or photograph people without their awareness.
- Alter an estimate, or use one to fake, inflate or falsely support a claim.
- Present an estimate as an appraisal, a shop's estimate or a licensed professional's opinion.
- Use the app as a paid appraisal or estimating service for other people.
- Use estimates to make automated decisions about insurance claims, coverage or vehicle safety.
- Let anyone under 18 use the app.
- Copy, scrape or reverse engineer the app or service, except where the law allows it.
- Use estimates or other output to train or build a competing AI model.
- Get around the free estimate, the monthly limit or any rate limit, or use someone else's ID.
- Disrupt, overload or try to break into the service.
9Your license to the app
We and our licensors own the app and the service, apart from your content. We license the app to you under Apple's Standard EULA, which sets out what that license allows. All other rights are reserved.
10Other companies' services
The app relies on Apple, OpenAI, RevenueCat, Amplitude and Railway. If one of them has a problem, the app may not work. A scan needs an internet connection, and it can fail.
The app can open Maps, Phone, Mail, your browser, Apple's subscription page, iPhone Settings and the share sheet. What happens there is up to those services and you.
11Disclaimers
This section does not apply to consumers in the EU or UK. Section 13 applies to them instead.
As far as the law allows, we provide the app, the service and every estimate "as is" and "as available". As far as the law allows, we give no warranties of any kind, whether express or implied, including that estimates are accurate or that the service will be uninterrupted or free of errors.
You are responsible for what you decide based on an estimate.
12Limits of liability
This section does not apply to consumers in the EU or UK. Section 13 applies to them instead.
As far as the law allows:
- We are not liable for indirect or consequential loss, or for loss of profit, data or goodwill.
- We are not liable for a repair costing more than an estimate, or for a shop or insurer rejecting one.
- Our total liability for all claims is limited to the greater of what you paid for Pro in the 12 months before the claim, or US$50.
Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not let us limit.
13Your consumer rights
Nothing in these Terms takes away rights that you have under consumer law and cannot give up. If a part of these Terms conflicts with those rights, those rights win.
If you are a consumer in the EU or UK, sections 11 and 12 do not apply to you. Instead:
- The law gives you rights over digital services, such as a service that matches its description and is provided with reasonable care and skill.
- We are liable for foreseeable loss that we cause by breaking these Terms or by not using reasonable care and skill.
- We are not liable for loss that was not foreseeable, or for business loss.
- Nothing limits our liability for death or personal injury caused by negligence, for fraud, for defective products, or for anything else the law does not let us limit.
14Apple's role
These points apply because you got the app from Apple's App Store.
- Parties. These Terms are between you and Dereck Ruzzman only, not Apple. Dereck Ruzzman, not Apple, is solely responsible for the app and its content. These Terms do not conflict with the Apple Media Services Terms and Conditions. If they ever do, Apple's terms apply to that point.
- Maintenance and support. Dereck Ruzzman alone provides maintenance and support for the app, as stated in these Terms or required by law. Apple has no duty to provide any.
- Warranty. Dereck Ruzzman alone is responsible for any product warranties, whether express or implied by law, to the extent they are not validly disclaimed. As far as the law allows, Apple has no warranty duty for the app. Any claims, losses, liabilities, damages, costs or expenses from a failure to meet a warranty are Dereck Ruzzman's responsibility.
- Product claims. Dereck Ruzzman, not Apple, is responsible for dealing with any claims by you or a third party about the app or your use of it. These include product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws. These Terms do not limit Dereck Ruzzman's liability to you beyond what the law allows.
- Intellectual property. If a third party claims that the app, or your use of it, infringes their intellectual property rights, Dereck Ruzzman, not Apple, is solely responsible for investigating, defending, settling and discharging that claim.
- Legal compliance. You confirm that you are not in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country. You also confirm that you are not on any US Government list of prohibited or restricted parties.
- Developer contact. Send questions, complaints or claims about the app to Dereck Ruzzman at carrepairestimate@apps.support.
- Third-party terms. You must follow any third-party terms that apply when you use the app, such as your wireless data service agreement.
15Governing law
The laws of the State of Delaware, United States, govern these Terms. If you are a consumer, you also keep the mandatory protections of the law where you live.
If you are a consumer in the EU or UK, you can bring a claim in the courts where you live, and we can only bring a claim against you there.
For everyone else, the courts of the State of Delaware, United States, handle disputes about these Terms, subject to local law.
16Changes to these Terms
We may update these Terms for legal, security or provider reasons, or when the service changes. We will change the date at the top. For a material change, we will tell you at least 30 days ahead, in an app update or on this page. If you keep using the app after that, the new Terms apply, unless the law requires your agreement. If you do not agree, stop using the app and cancel your subscription, and contact us for a refund of the unused part of a Yearly plan.
17Ending the service
You can stop at any time. Cancel your subscription through Apple and delete the app.
We may suspend or end your access if you break these Terms, or if we need to in order to protect the service or other people, or to follow the law. If we can reach you, we will tell you why first, unless it is urgent.
We may change the service for security, legal or provider reasons, or to improve it. If a change makes Pro materially worse, we will tell you at least 30 days ahead, in an app update or on this page, and you may cancel and get back the unused part of your payment. If we close the service, we will give at least 30 days' notice the same way, stop renewals and refund the unused part of a Yearly plan. Your statutory rights, and Apple's refund process, still apply.
Sections that by their nature should continue, such as 3, 11, 12 and 15, continue after these Terms end.
